Overview
Welcome to Danata Bullion Group (“DBG,” “Danata Bullion,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, services, communications, and transactions.
By accessing our website, creating an account, placing an order, or otherwise interacting with DBG, you agree to these Terms.
Our goal is to provide a modern, secure, and transparent precious metals experience. Because precious metals markets move rapidly and transactions involve fraud prevention, regulatory compliance, and market volatility, these Terms are important and form part of every transaction with DBG.
If you do not agree to these Terms, please do not use our services.
1. Eligibility & Account Use
You must be at least 18 years old and legally capable of entering into binding agreements in order to use DBG services or place an order.
DBG services are intended only for residents of the United States. We do not currently offer international sales or shipments.
You may browse portions of the website without creating an account, however certain services and purchases may require account registration, identity verification, or additional compliance review.
You agree that all information you provide to DBG is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.
DBG reserves the right to:
- refuse service;
- limit or cancel orders;
- suspend or terminate accounts;
- require additional identity verification;
- restrict access to certain services;
- delay or decline transactions for fraud prevention, compliance, operational, or security reasons.
2. Products, Pricing & Market Volatility
Precious metals markets move continuously and prices may change rapidly.
All pricing displayed by DBG is subject to change without notice until an order is formally submitted and accepted.
Once an order is placed and pricing is locked, the transaction becomes subject to market movement protections described in these Terms.
All prices are shown in U.S. Dollars.
While DBG works to ensure pricing accuracy, errors can occasionally occur due to technical issues, market feed interruptions, or human error. DBG reserves the right to correct pricing errors and cancel transactions impacted by material pricing inaccuracies.
Product availability is not guaranteed until an order has been confirmed and accepted.
Product images are for illustrative purposes only. Actual products may vary slightly based on mint year, packaging, or supplier changes.
3. Spot Prices & Market Data
DBG may display live or delayed precious metals spot prices, charts, market information, and related market data (“Market Data”) provided by third-party providers including NetDania and other market data licensors.
By using DBG services, you acknowledge and agree that:
- Market Data is provided for informational purposes only;
- Market Data may be delayed, inaccurate, interrupted, incomplete, or unavailable;
- DBG does not guarantee the accuracy or availability of Market Data;
- Market Data does not constitute investment advice, financial advice, trading advice, or a recommendation to buy or sell;
- Market Data providers, including NetDania, disclaim liability relating to such data;
- You may not reproduce, redistribute, republish, retransmit, commercially exploit, scrape, or disseminate Market Data without authorization;
- All intellectual property rights relating to Market Data remain with the applicable providers and licensors.
Market Data and related services are provided on an “as-is” and “as-available” basis.
Prior to executing any transaction, customers should independently verify pricing information.
Neither DBG nor any market data provider shall be liable for:
- interruptions in service;
- delayed quotes;
- pricing inaccuracies;
- charting interruptions;
- feed outages;
- technical malfunctions;
- trading losses;
- investment losses;
- lost opportunities;
- consequential damages arising from reliance on Market Data.
By continuing to use DBG services, you acknowledge and accept these Market Data terms.
4. Payment Methods & Payment Processing
DBG may accept one or more of the following payment methods:
- Bank Wire
- ACH / eCheck
- Credit or Debit Card
- Other payment methods approved by DBG
Available payment methods may vary based on order size, customer history, fraud screening results, operational risk, product category, compliance review, or payment processor limitations.
DBG currently does not accept cash transactions.
Certain payment methods may require identity verification, address verification, enhanced fraud review, payment clearing periods, or additional documentation.
DBG reserves the right to hold orders pending verification, refuse certain payment methods, cancel transactions, request alternate payment methods, limit transaction amounts, or delay shipment pending payment clearance.
Orders not paid within required timeframes may be canceled and subject to market loss provisions.
Customers represent and warrant that they are authorized to use submitted payment methods, submitted payment information is accurate, funds used for transactions are lawful, and transactions are not fraudulent or unauthorized.
Chargebacks, payment disputes, ACH reversals, unauthorized transaction claims, payment fraud, or attempts to circumvent DBG fraud prevention procedures may result in:
- immediate account suspension;
- transaction cancellation;
- refusal of future service;
- collections activity;
- reporting to payment processors or financial institutions;
- legal action where appropriate.
DBG reserves the right to recover market losses, collection costs, chargeback fees, carrier losses, insurance deductibles, attorney fees where permitted by law, and other damages arising from fraudulent, unauthorized, or failed transactions.
Additional payment processing rules, payment timelines, payment method restrictions, and related operational details may be described in DBG’s Payment Policy, which is incorporated into these Terms by reference.
5. Order Acceptance & Market Loss Policy
When you place an order with DBG and pricing is locked, you are committing to complete the transaction at the agreed price.
Because precious metals markets fluctuate rapidly, DBG may hedge market exposure immediately after order confirmation.
If you cancel an order, fail to remit payment, initiate a chargeback, refuse delivery, fail identity verification, or otherwise fail to complete a locked transaction, DBG may assess a Market Loss Fee.
The Market Loss Fee represents the market exposure and losses incurred by DBG as a result of the failed transaction.
You authorize DBG to recover Market Loss Fees using any payment method associated with your transaction where legally permissible.
Market gains resulting from canceled or defaulted transactions belong solely to DBG.
6. Shipping, Delivery & Risk of Loss
DBG currently ships only within the United States.
For security, fraud prevention, and insurance compliance purposes, DBG reserves the right to determine shipment methods, carriers, signature requirements, insurance procedures, shipment timing, packaging standards, and address eligibility.
Orders may require adult signature confirmation, direct signature confirmation, address verification, shipment exclusively to verified addresses, or additional fraud screening prior to shipment.
DBG may decline shipment to freight forwarders, forwarding services, mail drops, virtual mailboxes, commercial receiving agencies, high-risk addresses, or addresses that cannot be verified.
Customers are responsible for ensuring shipment information is accurate and current. Shipping timelines are estimates only and are not guaranteed.
DBG reserves the right to delay shipments, hold shipments for verification, require additional documentation, reroute shipments where permitted, refuse shipment methods, or cancel shipments where fraud, security, carrier, insurance, compliance, or operational concerns exist.
For security and insurance reasons, shipments may arrive in unbranded or discreet packaging.
Risk of loss transfers in accordance with carrier confirmation, delivery confirmation, signature confirmation, and applicable law.
Once a shipment is marked delivered by the carrier to the verified delivery address, DBG is not responsible for theft, loss, or damage occurring afterward.
Customers must promptly notify DBG regarding damaged packages, suspected tampering, missing contents, delivery discrepancies, or suspected carrier loss.
Customers agree to cooperate with DBG, carriers, insurers, financial institutions, and law enforcement in connection with shipment investigations, insurance claims, fraud investigations, or delivery disputes.
Additional shipping procedures, timelines, carrier policies, insurance details, and delivery requirements may be described in DBG’s Shipping Policy, which is incorporated into these Terms by reference.
7. Returns, Refunds & Exchanges
Because precious metals markets fluctuate continuously, all returns, cancellations, exchanges, and failed transactions are subject to market risk protections.
Return eligibility may vary by product type, payment method, shipment status, market conditions, and fraud/compliance review.
Certain items may be designated as final sale, non-returnable, special order, limited release, or otherwise ineligible for return.
Approved returns and exchanges may be subject to market loss fees, shipping charges, insurance costs, restocking costs, payment processing costs, or other operational expenses.
Products returned to DBG must remain in original condition, remain untampered with, include original packaging where applicable, and comply with DBG return authorization procedures.
Any claim relating to missing items, shipment discrepancies, damaged products, tampering, incorrect items, or delivery-related concerns must be reported to DBG no later than three (3) calendar days following confirmed delivery or signed receipt.
For security and claim-protection purposes, DBG strongly recommends that customers:
- record the opening of packages while the shipment remains sealed and intact;
- capture the shipping label and package condition on video prior to opening;
- retain all packaging materials;
- photograph any damage, tampering, or discrepancies immediately upon discovery.
DBG reserves the right to deny claims where reporting delays materially impair investigation ability, evidence has been discarded prematurely, fraudulent activity is suspected, or customers fail to cooperate with reasonable investigation requests.
Additional procedures and conditions relating to returns, exchanges, refunds, market loss calculations, cancellation procedures, and shipment discrepancy investigations may be described in DBG’s Return Policy, which is incorporated into these Terms by reference.
8. Fraud Prevention & Compliance
DBG maintains fraud prevention, anti-money-laundering (“AML”), and customer identification procedures designed to protect customers, payment networks, financial institutions, and DBG.
DBG reserves the right to request identity documentation, request proof of address, require payment verification, record communications where permitted by law, decline transactions, report suspicious activity where legally required, and cooperate with law enforcement, regulators, payment processors, and financial institutions.
Attempted fraud, abuse of payment systems, market manipulation, identity misrepresentation, or circumvention of security controls may result in account termination, transaction cancellation, and referral to law enforcement.
9. No Investment Advice
DBG is a precious metals retailer. DBG does not provide investment advice, financial advice, legal advice, tax advice, retirement planning advice, or trading recommendations.
Any educational, market, or product information provided by DBG is general in nature and should not be relied upon as individualized financial guidance.
Customers should consult their own financial, legal, tax, or investment professionals before making financial decisions.
All investments, including precious metals, involve risk.
10. Intellectual Property
All DBG branding, website content, product photography, graphics, software, text, design elements, and related intellectual property are owned by DBG or its licensors.
You may not copy, reproduce, republish, scrape, distribute, commercially exploit, reverse engineer, or train artificial intelligence systems on any DBG content without written permission.
11. Disclaimer of Warranties
DBG services, products, software, pricing feeds, and website content are provided on an “as-is” and “as-available” basis.
To the fullest extent permitted by law, DBG disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, uninterrupted access, accuracy of information, and non-infringement.
DBG does not guarantee that the website or services will always be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, DBG shall not be liable for indirect damages, incidental damages, consequential damages, trading losses, market losses, lost profits, lost opportunities, data loss, shipping delays, third-party service failures, or interruptions in market data.
DBG’s maximum aggregate liability relating to any transaction shall not exceed the amount paid by the customer for the applicable transaction.
13. Dispute Resolution, Arbitration & Class Action Waiver
DBG believes most issues can be resolved professionally and efficiently through direct communication.
If a dispute arises relating to DBG services, transactions, shipments, payments, or these Terms, the parties agree to first attempt to resolve the matter informally and in good faith.
If a dispute cannot be resolved informally, either party may request non-binding mediation. Unless otherwise agreed by the parties, mediation may occur remotely or in Lee County, Florida.
If a dispute remains unresolved following informal resolution efforts or mediation discussions, the dispute shall be resolved through binding arbitration on an individual basis.
Arbitration shall:
- be conducted in Lee County, Florida;
- be governed by the Federal Arbitration Act where applicable;
- proceed on an individual basis only;
- and not proceed as a class action, consolidated action, or representative proceeding.
To the fullest extent permitted by law, customers waive the right to a jury trial, the right to participate in class actions, and the right to participate in representative claims.
Nothing in this section prevents either party from seeking relief in small claims court where eligible, pursuing temporary injunctive relief, or protecting intellectual property, confidential information, fraud-prevention rights, or security interests in a court of competent jurisdiction.
This section survives termination of any transaction or customer relationship with DBG.
14. Privacy
Use of DBG services is also governed by the DBG Privacy Policy.
15. Changes to Terms
DBG may update these Terms periodically. Updated Terms become effective upon posting. Continued use of DBG services after updates constitutes acceptance of the revised Terms.
